Animal Cruelty – Criminal Penalties

1st  offenses for animal cruelty are Class 1 Misdemeanor with the following possible penalties:

Fines:

  • mandatory minimum fine of $500
  • fines ranging from  $500 to  $5,000

Incarceration:

  •  up to 18 months county jail

Evaluation:

  • The court must also order an evaluation prior to sentencing for the purpose of assisting in the determination of  the appropriate sentence.

Treatment:

  • The court may order successful completion of anger management or other treatment. If the mandatory evaluation recommends anger management or other treatment, the judge must order successful completion of that treatment.

2nd offenses for animal cruelty are Class 6 felonies with the following possible penalties:

Fines:

  • a mandatory minimum fine of $1000, and
  • a maximum fine of $100,000

Incarceration:

  • up to 18 months Department of Corrections
  • mandatory 90 days jail or in home detention

Evaluation:

  • The court must also order an evaluation prior to sentencing for the purpose of assisting in the determination of  the appropriate sentence.

Treatment:

  • The court must order the successful completion of anger management or other treatment. 

 

NOTE:   Comprehensive and accurate evaluations of an animal cruelty offenders performed by evaluators with “offense specific” knowledge of animal cruelty can assist in determining if anger management is appropriate or if other treatment interventions would be indicated.
